The marriage agreement in Thailand is signed on the basis of the mutual agreement of the man and woman who want to marry. Under Thai law, a marriage contract is recognized by Thailand`s commercial and civil code. A valid and enforceable Thai marriage agreement requires the law where: when a U.S. citizen decides to marry an immigrant, that person often serves as a visa sponsor to ask his fiance to enter or stay in the United States. The Dept. Homeland Security requires that persons who sponsor their fiance come to the United States on a visa to make a declaration of support and it is important to consider the obligation under oath to support a U.S. sponsor about to sign a pre-married agreement. The Asidavit of Support establishes a 10-year contract between the U.S. government and the sponsor, which requires the sponsor to financially support the fiancé on its own resources. As expressly stated on Form I-864, divorce does not end the obligations of assistance owed by the promoter of the U.S. government and the immigrant spouse to rights as a third party beneficiary of the sponsor`s promise of support in the affidavit I-864.
As such, any waiver of support in their marriage contract must be formulated in a manner that is not contrary to the contract that the U.S. sponsor makes with the government by providing affidavit support or may be declared unenforceable. Unlike all other contract laws, no consideration is necessary, although a minority of courts denounce marriage itself in return. Through a prenup, a spouse can completely waive property rights, support or inheritance, as well as the voting share, and can get nothing for it. The choice of legal provisions is crucial in the prenups. Contracting parties may decide that the law of the state in which they are married governs both the interpretation of the agreement and the division of property at the time of divorce. In the absence of a legal choice clause, it is the law of the place where the parties divorce, not the law of the state in which they were married, that decides matters of ownership and support. Couples can reduce their chances of marital discord by addressing potential financial, family and interfaith problems. Conflicts over these issues often lead to divorce.
Discussing these topics now and getting out of them can help improve your marriage in the future. Without the advice of a legal expert, you could fall into several traps when preparing a prenupe. Under what conditions would you like, for example, to review the agreement? How will Prenup make substantial future financial changes in your partner`s position? What if they have children and one of you leaves work to look after them? This and many other considerations must be taken into consideration if you want to prepare a mandatory prenup. In many of these countries, criminal history can also protect unshared assets and money from bankruptcy and can be used to support lawsuits and transactions during marriage (for example. B if a party has unduly sold or mortgaged land set aside by its partner). In India, marital agreements are very rare and have no laws in force.
